SIX STEP STRUCTURE OF A JOINT FACE-TO-FACE MEDIATION MEETING
(After mediator has had individual meetings
with the parties involved) |
I.
INTRODUCTIONS/ GROUNDRULES
• Positive
welcome and introduction
• Confirm purpose of the mediation and their wish to resolve
• Agree groundrules i.e. no interrupting, treating each other
with respect, confidentiality of discussions

II.
HEARING FROM EACH PERSON & SUMMARISING BACK
(Communication through the mediator)
• 'What
do you feel has been happening in your working relationship ?'
• Mediator listens and summarises back for each person
|
III.
IDENTIFYING THE ISSUES
(Communication through the mediator and together)
• Clarifying
the underlying issues (and if several, will be put up on flipchart)
• Discussion of each issue
|
IV.
COMMUNICATING FEELINGS & MUTUAL UNDERSTANDING
(Through the mediator and with each other)
• More
direct coomunication with each other and explanations
• Encouraging mutual understanding and honest exchange of
feelings
|
V.
IDEASTORMING AND IDENTIFYING SOLUTIONS
(Together)
• ‘What
needs to happen for things to improve between you?’
• Brainstorming all kinds of possible win/win solutions
• Clarifying mutually agreed solutions
• Checking the specific details of the mediation agreements
|
VI.
SIGNING THE AGREEMENT

Mediator
writes up the voluntary agreements for parties to check and
to sign
(agreements may be verbal only if agreed beforehand) |

A follow-up
meeting is agreed at a future date with the
mediator to see how the agreements are working out
|
